11. Summary of the new findings of the thesis:

The research purpose of thesis is to build a theoretical basis for the adhesion  contract and the law on the adhesion contract; proposing specific solutions to perfect the adhesion  contract law and improvement effectiveness of law enforcement on adhesion contract in Vietnam. To do that purpose, the thesis studies the theoretical issues of the adhesion  contract and the law of the adhesion contract on the World and Vietnam; Actually situation of the law on adhesion  contracts in Vietnam today at present. The thesis uses the following general research methods of social sciences and humanities: Analysis method; Synthetic method; Comparative method; Statistical method; Historical method; Comparative Law method…

The thesis has some new scientific contributions as follows:

Firstly, the thesis has done a fairly complete review and evaluation, details of the research situation on the World and Vietnam related to the thesis topic, that indicates the issues, contention that the thesis needs to continue researching and these issues are clarified in the scope and research content of the thesis;

Secondly, from different approaches to the concept and characteristics of the adhesion  contract of previous domestic and foreign researchers, the thesis builds a theoretical model of the adhesion contract and contractual law by building a generalized adhesion contract concept, reflects the basic characteristics of this type of contract, thereby clarifying the legal nature of the contract as well as classification of the current adhesion contracts. Based on research on economic theories and legal theories. The thesis analyzes the philosophical foundation of the need to control the conclusion and implementation of the adhesion contract by law; clarify the cause of the State's intervention by law to adjust the adhesion contract in the direction of protecting the weak in the contractual relationship but still does not break the principle of freedom of contract. Then, the thesis identifies the contents that the contractual law needs to be completed to protect the weak in the contractual relationship, to balance the interests of contracting parties.

Thirdly, the thesis is a research work that evaluates in a systematic way, comprehensively on the legal status of adhesion  contracts in Vietnam under the content perspective of the current contractual law provisions, indicates existences, shortcomings of the current adhesion contract legal system as well as law enforcement practice in some specific areas.

Fourthly, the thesis proposes specific solutions to perfect the adhesion contract law and solutions to improve efficiency of law enforcement on adhesion  contracts in Vietnam in order to be compatible with the increasingly diverse and expanding business environment, to response the requirements of developing a multi-sector commodity economy under the state management according to the socialist orientation, international economic integration. Specific solutions include: Completing the regulations of the adhesion  contract; completing the regulations on contractual adhesion control; improving the efficiency of law enforcement on the adhesion  contract.

12. Practical applicability, if any: Research results, conclusions and recommendations of the thesis also serve as a basis for legislators to choose, apply in the codification of legal documents on the adhesion contract in Vietnam in order to improve the efficiency of law enforcement on adhesion  contracts in Vietnam at present.
