Information on Doctoral thesis of Fellows Nguyen Thi Thu Hong

11. Summary of the new findings of the thesis:

As the first scientific work to study in-depth, systematically and comprehensively the theoretical and practical issues of regulation and implementation of the law on public property auction in Vietnam, the thesis has the following major new contributions:

11.1. The thesis has proposed to build a completely new public property auction model in Vietnam in order to preserve and aim for the added value of public properties put up for auction, to limit collusion, profiteering, and loss of money: ascending auction model with reservation;

11.2. The thesis has proposed to amend and supplement the provisions of the Law on Property Auction on public property auction to be suitable with the ascending  auction model with reservations, international conventions and practices in Vietnam, such as: amending and supplementing regulations on asset auction organizations conducting public asset auctions and the selection of public asset auction organizations; amending and supplementing the valuation of public properties put up for auction (determining the starting price and reserve price); amending regulations on information disclosure, organization of registration for participation in auctions, operation of public property auctions, determination of unsuccessful public asset auctions;

11.3. The thesis has proposed to modify the provisions of the Law on Property Auction on contract entering in public asset auction, specifically: (1) Redefining the offer and accepting the offer to enter into a contract in the ascending auction in accordance with the theory of ascending auction and the theory of contract, thereby proposing amendments to Clause 3, Article 46 of the Law on Property Auction; (2) Determining the time to conclude the contract in the ascending auction based on the contract theory and experience of some countries in the world, thereby proposing to supplement regulations on the time of entering into the contract in ascending auctions and propose amendments to Clause 3, Article 44 and Clause 3, Article 46 of the Law on Property Auction accordingly; (3)

Proposing amendments and supplements to regulations on sanctions for handling violations in case the auction winner refuses to sign the auction minutes and in case the auction result is rejected in the direction of determination and handling according to contract violation;

11.4. The thesis has proposed amending and supplementing a number of general provisions of the law on property auction, such as: amending and supplementing regulations on price steps, service remuneration, property auction costs, etc.

12. Practical applicability:

12.1. With the obtained research results, the thesis contributes to building an in-depth, comprehensive and systematic theory on public property auction and the law on public property auction in Vietnam. Therefore, the thesis is qualified to become a reference in research, teaching and learning in Vietnam;

12.2. The thesis clarifies legal issues, existing inadequacies; thereby offering solutions to amend and supplement the law on public property auction in Vietnam. The conclusions and recommendations of the thesis are of reference value in the process of completing policies and laws on public property auction in Vietnam. The thesis is also a useful reference for property auction organizations and working auctioneers.
