11. Summary of the new findings of the thesis:

From the theoretical point of view, the thesis has:

+ Clarified the definition, origin, characteristics and content of the principle that judges and jurors conduct trial independently and abide by law only in criminal procedure law; the factors affecting the implementation of this principle. Identified and analyzed the laws of some countries and international law on the principle of judicial independence in criminal procedure, drawing reference values for Vietnam.

+ Analyzed legal provisions on the principle that judges and jurors conduct trial independently and abide by law only in the history of criminal procedure law in Vietnam; evaluated the results of the implementation of this principle in accordance with the provisions in Criminal Procedure Code (2003); limitations, constraints, causes and and the necessity for improvement.

+ Specified the requirements and proposed solutions to ensure the implementation of the principle that judges and jurors conduct trial independently and abide by law only in the criminal procedure law, meeting the requirements of judicial reform, protection of justice and protection of human rights.

12. Applicability in practice, if any:

The results of the study can be applied in finalizing the criminal procedure law and guiding the implementation of the principle of judicial independence in the practice of criminal trials. The thesis is a reference for law training, training and fostering the judges, jurors and those who are interested in judicial activities.

13. Further research direction, if any:

Studying the implementation of the principle that judges and jurors conduct trial independently and abide by law only in Criminal Procedure Code (2015) in order to make new recommendations for the improvement of this principle under the judicial reform process in the coming years.
