11. Summary of the new findings of the thesis:

The dissertation forms the theoretical models for settling the trademark disputes. Of these, the new results are studies as followings:

- Clearly analyzing the characteristics of the trademarks to determine the civil or commercial or special nature of the trademark disputes;

- Evaluating the effectiveness and suitability of the dispute settlement method by the state authorities in Vietnam currently;

- Building the systematic theories of the dispute settlement methods by the state and non-state agencies related to the trademarks;

- Developing the principles for encouraging and limiting among the trademark dispute settlement methods in a balanced manner.

- Recommending the solutions to develop and improve the existing Vietnam Law on settling trademark disputes methods.

12. Practical applicability:

- The dissertation is the first monographic project which studies systematically and comprehensively the settlement of trademark disputes under the Vietnam Law in a PhD dissertation of Legal Studies. The recommendations about the solutions to improve the mechanism of the trademark dispute settlement in Vietnam currently may serve efficiently the legislation as well as the executive.

- Additionally, the dissertation also plays the role as a reference for legal researchers, lecturers, research students, master’s degree students and students majoring Economic Law at university institutions, post-graduate ones in Vietnam.

13. Further research directions: Strengthen capacity to resolve trademark disputes in Court.
