11. Summary of the new findings of the thesis:

As a relatively comprehensive and systematic scientific research on the law on unfair competition control related to trademarks in Vietnam, the thesis has the following main results:

Firstly, the thesis systematized the theory of unfair competition related to trademarks, analyzed the trademark characteristics as an intellectual property; analyzed the specific characteristics of unfair competition related to trademarks; clarified the theory of unfair competition control related to trademarks in the following contents: concepts, characteristics, and requirements of unfair competition control related to trademarks.

Secondly, researching and developing a legal theoretical model of unfair competition control related to trademarks in the following contents: Mechanism of behavioral determination; mechanism of behavior control and processing; institution of the competent agency in controlling and handling behaviors; principles of applying the law ...

Thirdly, generalizing, analyzing and evaluating the current situation of Vietnamese laws and regulations as well as the practice of law enforcement in controlling (against) unfair competition behaviors related to trademarks in accordance with the Competition Law, Intellectual Property Law and guiding documents, indicating the limitations and problems that need to be improved.

Fourthly, proposing orientations and recommending solutions to improve the law as well as ensure effective enforcement of the law on unfair competition control related to trademarks in accordance with legal conditions as well as the development process of the socialist-oriented market economy in Vietnam.

12. Practical applicability, if any:

From the evaluation results, objectively summarizes the current status of the law on unfair competition control related to trademarks in Vietnam, thereby, can bring reference value for lawyers, researchers, legislators, entities that exercise control of unfair competition related to trademarks (enterprises, consumers, competent state agencies)… The thesis can be a reference document Reference for the development and improvement of the law, serving research, teaching and raising legal awareness.
